These Terms of Service ("Terms") govern your use of the PureFocus mobile application ("App") and the website purefocus.tech ("Website"), collectively referred to as the "Service", operated by Guilherme Santiago de Oliveira ("we", "us", or "our").

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

2. Account Registration

To access certain features, you may need to create an account. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized use of your account
Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. The Service

PureFocus provides neuroscience-based audio content designed to support focus, relaxation, sleep, and general wellbeing. The Service is available as:

Free tier: access to limited features with advertisements
Premium tier: access to all features without advertisements, available via subscription or in-app purchase

4. Subscriptions and Payments

PureFocus Premium is available through auto-renewable subscriptions processed by Apple (App Store) or Google (Google Play). By subscribing, you agree to the following:

Payment is charged to your App Store or Google Play account at confirmation of purchase
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
You can manage and cancel subscriptions through your device's account settings (App Store or Google Play)
No refunds will be provided for unused portions of a subscription period, except as required by applicable law or the policies of Apple or Google

Prices may change from time to time. We will notify you in advance of any price changes that affect your active subscription.

5. Free Trial

We may offer free trial periods for Premium features. If you do not cancel before the trial ends, you will be charged the applicable subscription fee. Free trial eligibility is determined by Apple or Google and is typically limited to one trial per account.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Copy, redistribute, or commercially exploit the audio content provided through the Service
Reverse engineer, decompile, or disassemble the App
Attempt to gain unauthorized access to any part of the Service
Interfere with or disrupt the Service or its servers
Use automated tools, bots, or scripts to access the Service

7. Intellectual Property

All content in the Service, including but not limited to audio tracks, music, visual designs, graphics, logos, icons, and software, is owned by or licensed to Guilherme Santiago de Oliveira and is protected by copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. This license does not permit you to download, record, redistribute, or create derivative works from any audio content.

8. Health Disclaimer

Important: PureFocus is a wellness and productivity tool. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition, including but not limited to ADHD, autism, insomnia, or any mental health disorder. The audio content is designed to support focus and relaxation but should not be used as a substitute for professional medical advice. If you have a medical condition, consult a healthcare professional before use.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied
We do not guarantee that the Service will be uninterrupted, error-free, or secure
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid for the Service in the 12 months preceding the claim

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:

Your license to use the Service is immediately revoked
We may delete your account and associated data
Sections of these Terms that by their nature should survive termination will remain in effect

You may terminate your account at any time by contacting us at [email protected] or by deleting your account within the App.

11. Third-Party Services

The Service may contain links to or integrations with third-party services (such as Apple App Store, Google Play, and payment processors). We are not responsible for the practices or content of these third-party services. Your use of such services is subject to their respective terms and privacy policies.

12. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Brazil, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the competent courts of Brazil.
